Terms of Service

Last updated October 22, 2026

Draft. These terms are a working draft and have not yet been reviewed by an attorney. They will be finalized before launch.

These Terms of Service ("Terms") govern your use of Scribberty (the "Service"). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of an organization, you agree on its behalf and confirm you have authority to do so.

1. The Service

Scribberty converts audio and video recordings you provide into text transcripts, and provides tools to edit, share and export them. Transcripts are produced by automated systems and may contain errors. You are responsible for reviewing any transcript before relying on it.

2. Accounts

You must provide accurate information and keep your password secure. You are responsible for activity under your account and your workspace, including activity by members you invite and by API keys you create. Tell us promptly at support@example.com if you suspect unauthorized access.

3. Prohibited content: protected health information

The Service is not designed or certified for protected health information (PHI) as defined under the Health Insurance Portability and Accountability Act of 1996 (HIPAA), and Scribberty does not enter into Business Associate Agreements. You agree not to upload, submit, email or otherwise transmit any PHI to the Service, and not to use the Service as or on behalf of a covered entity or business associate to process PHI. If PHI is submitted in violation of this section, you will delete it from the Service promptly, and you are solely responsible for any resulting obligations, including any breach notification duties. We may delete content we reasonably believe contains PHI.

4. Your content

You keep all rights to the recordings and transcripts you provide or create ("Your Content"). You grant us a limited license to store, process and transmit Your Content only as needed to provide the Service to you, including through the subprocessors listed in our Privacy Policy. We do not use Your Content to train machine learning models. You confirm that you have the rights and any consents needed to record and upload Your Content, including the consent of people recorded where the law requires it.

5. Acceptable use

You will not use the Service to violate any law or anyone's rights; to upload content you have no right to process; to interfere with or probe the Service's security; to exceed rate limits or resell the Service without our written permission; or to upload malware.

6. Prepaid credit and payment

The Service is paid for with prepaid credit. Usage is charged at the rate shown on the pricing page when a transcript completes, billed to the second. Failed and canceled jobs are not charged. Credit does not expire while your account is open. Unused credit may be refunded within 30 days of purchase on request. Promotional credit, such as the sign-up grant, has no cash value. We may change prices with 30 days' notice; changes do not affect credit already purchased.

7. Sharing

Share links you create give anyone with the link read-only access to the transcript, and to the audio if you allow it. You are responsible for whom you share links with. You can turn off a link at any time.

8. Retention and deletion

Audio is kept for the retention period set on each project, then deleted. Transcripts are kept until you delete them or close your account. Deleted content is removed from active systems promptly and from backups within 30 days.

9. Suspension and termination

You may close your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or others. On termination we will delete Your Content as described above.

10. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and accuracy of transcripts.

11. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of these Terms or the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data.

12. Indemnity

You will defend and indemnify us against claims arising from Your Content or your breach of these Terms, including Section 3.

13. Changes

We may update these Terms. If a change is material we will notify you by email or in the app at least 14 days before it takes effect. Continued use after that means you accept the change.

14. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Maricopa County, Arizona.
